Privacy Policy

This policy describes how JouleBug collects, uses and shares information collected through our JouleBug mobile applications (the “Apps”) and any of the joulebug.com websites that link to this privacy policy (the “Websites”), (collectively, “Services”). We strive to be transparent with you about what information we collect and how we use it and what your choices are related to your information.

This Privacy Policy is incorporated into, and is subject to, the Terms of Use. By using any of the Services, you accept and consent to the practices described in the Privacy Policy and Terms of Use. If you do not agree to the Terms of Use or this Privacy Policy, please do not use Services.

How We Collect and Use Information

Through your use of Services, we collect both personal information (“PI”) and anonymous information. PI is any information that allows a person to become identifiable. Anonymous information is any information that has had the PI stripped out so that it is not personally identifiable.

Contact Information

We collect your email address, name, profile photo, organization name when you provide it to us by registering in any of the Apps or submitting it via any of the Websites. We use this information to identify you when you enroll and to provide Services to you. This includes events such as displaying your progress and rewards in the App, making you aware of impact and savings in the App, and responding to your questions and requests for support.

Geographic Location

Our Apps may collect precise geographic location information from your mobile device when you choose to enable location sharing. When you first download the App and create a profile, you will be presented with a clear opt-in request to allow the App to access your device’s GPS-based location data. We use this information to provide location-based features and make recommendations within the App.

You are not required to enable location sharing to use the App; however, certain features or Services may be limited or unavailable if you do not provide this permission. You may withdraw your consent and disable location sharing at any time through the App settings or your device’s operating system settings. Our collection and use of location data are designed to comply with applicable data protection laws, including GDPR and CCPA.

Usage Information and Analytics

We automatically collect certain identifiers, such as your IP address, device ID, and user ID, from your browser or mobile device when you use our Apps or visit our Websites. This information is used to provide, maintain, and improve our Services, as well as to analyze and enhance our offerings. We may engage third-party analytics providers, including Google Analytics and PostHog, to help us understand how users discover and interact with JouleBug, which features are most frequently used, and to identify culturally relevant updates that ensure our content remains effective and compliant with applicable laws.

Information You Post

When you use our Apps, you may post user-generated content, such as photos, comments, or other information. Unless your organization has established a private, closed ecosystem, when you share information in the app, whether personal or not, it becomes public. If you don’t want it to be public, please don’t post it.

Anonymous Information

When you use the Services, we may collect certain data that does not directly identify you. This may include diagnostic and usage data, browser type, device information, and your settings or preferences. We collect this information using cookies and similar technologies, as detailed in the Cookies section below.

Where required by applicable law, such as the GDPR and CCPA, we collect this information only after obtaining your consent through our cookie consent mechanism. We use this data to analyze usage trends, enhance the performance and functionality of the Services, and ensure their secure and reliable operation. You may manage or withdraw your cookie preferences at any time, as described in the “cookies” section.

How We Share Information

We do not disclose your PI to third parties, except as follows:

  • To subprocessors that provide services to us or perform functions on our behalf (such as deployment of our app) and have agreed to use your information only for the purposes we request;

  • For us to send offers to App users on behalf of our affiliated companies and on behalf of other non-affiliated partners (such as environmental, diversity and inclusion groups that we support);

  • When we believe disclosure is appropriate to comply with applicable law, legal process, and/or governmental authorities;

  • When we believe disclosure is appropriate to enforce our Terms of Use and other agreements, or to protect our rights, our customers, our property, our employees, or others; and

  • If we are involved in a merger, acquisition, bankruptcy, partial or total sale of assets, or other corporate change.

We may disclose anonymous aggregated information to third parties in our discretion. The Services or our offerings on social media platforms may include commenting, forums, sharing, or other similar features. Information that you provide using these features may be available to other users or the general public.

Your Choices

With regard to your PI, you have the right to access, correct, or delete your information at any time, including deleting your account (link). You also have several options to control our use of your PI, particularly in connection with marketing and promotional activities.

Importantly, we will not share your PI with third parties for any purpose without first obtaining your explicit consent, unless required by law.

You may remove your name from our communication lists at the time we request your PI, or at any time afterward, by contacting us directly by mail, email, or telephone using the contact information below. After we have collected your PI, you may also stop receiving communications or opt out of our services.

To opt out of email communications, simply click the “Unsubscribe” link at the bottom of any promotional email you receive from us.

To prevent the collection of your device’s geographic location, you may disable this function either when you first use the App or in your device settings. Please note that disabling location services may limit some features of the App.

Correcting or Updating Your Information

If you would like to request changes to the PI that you have previously provided to us, you have the ability within the App to change your user name and delete your account (link). You can also request a correction or update by contacting us by email using the contact information below.

Cookies

We may use “cookies” and other similar technologies to collect information in connection with the Services. A cookie is a small piece of text sent to your browser by a website you visit. It helps the website to remember information about your visit, like your preferred language and other settings. That can make your next visit easier and the site more useful to you. For example, we use cookies while you browse the Websites and App and to track the effectiveness of our App and Dashboard.

Most browsers accept cookies automatically. You may be able to set your browser to reject and/or delete cookies. For instructions, check your browser’s technical information. However, if you reject or delete cookies then this may disable or interfere with features of the Services or other websites you visit. We recommend that you leave cookies “turned on” so we can offer you a better experience on the Website and App.

Children

Access or use of the Service is not intended for children unless their use is directly authorized by their parent, guardian or another authorized adult (such as a teacher) who agrees to be bound by these Terms. For purposes of these Terms, a child is a person under the age of 18 (or the minimum legal age required to provide consent for processing of personal data in the country where the child is located).

Third Parties and Social Media

Our Website and App may contain links to third-party online properties. Such third parties have their own policies that govern their collection, use, and disclosure of information. We suggest that you read their privacy policies to learn about their practices.

Social media provides tools that many of our customers use and enjoy. If you interact with these social media tools through the Website and App, your experience on those social media sites will be governed by the privacy and other policies of those sites. So, the privacy settings you have chosen on those sites will determine the degree to which your information is made public. We encourage you to choose your privacy settings on those sites accordingly.

Safeguarding Your PI

We have reasonable and appropriate physical, electronic, and administrative measures in place to safeguard the security of your personal information. However, when you communicate with us via email or chat on the Website, these communications may not be encrypted. For that reason, we ask that you do not share sensitive information via these communication channels.

Your Privacy Rights

The California Consumer Privacy Act (“CCPA”) and, potentially, other applicable state or federal laws provide you with rights regarding how your data or personal information is treated, and we want to ensure you understand and are able to exercise those rights.

Your Rights Regarding Personal Information. You have the following rights with respect to the personal information we collect, subject to certain exceptions and limitations:

  • For certain categories of personal information, the right to request a list of what personal information (if any) we disclosed to third parties for their own direct marketing purposes in the preceding calendar year and the names and addresses of those third parties;

  • The right to know the categories and/or specific pieces of personal information we collect, use, disclose, and sell about you, the categories of sources from which we collected your personal information, our purposes for collecting your personal information, the categories of your personal information that we have either sold or disclosed for a business purpose, and the categories of third parties with which we have shared personal information;

  • The right to request that we delete the personal information we have collected from you or maintain about you.

  • The right to opt out of our sale of your personal information.

  • The right not to receive discriminatory treatment for the exercise of your privacy rights under the CCPA.

To exercise any of the above rights, please contact us using the information in the Contact Us section below and submit the required verifying information.

Certain Unidentifiable Personal Information. There may be information that is designated as personal information under the CCPA or other state or federal laws, but this information, on its own, does not allow us to identify you in our systems—for example, search or browsing history. If this information is the only information we have collected on you, we will notify you that you are unidentifiable to us – we are not able to find information about you in our systems.

Verification Process and Required Information. We may need to request additional information from you to verify your identity or understand the scope of your request, although you will not be required to create an account with us to submit a request or have it fulfilled. We will require you to provide, at a minimum, your email address, and full name.

Authorized Agent. You may designate an authorized agent to make a request on your behalf, which, for your protection, we will also need to verify as authentic.

Updates to Our Privacy Policy

If we modify this Privacy Policy, we will post the revised Privacy Policy online. We will notify you if the policy changes in any material way by sending a notification to the App, a notice to the email address you provided us, or by placing a prominent notice on the Website. You should check regularly to see if this Privacy Policy has changed.
